Shipping Policy

The GPS Place requires a physical street address for shipping. We cannot ship to PO Boxes, FPO, APO, or any other non physical addresses. We can make some exceptions for smaller orders under $50, however we reserve the right to cancel orders that do not have a physical shipping address.

Shipping options are UPS, USPS, or Fedex. Every effort is made to ship the same business day as your order; all orders should be shipped no later than the business day following your order if the product(s) are available.

The GPS Place may on occasion substitute a comparable shipping method in order to expedite your order.  For example, if you chose UPS Ground, we may choose to send the product USPS Priority Mail if delivery will be faster.

In the event, there are backorders or shortages on your order, you will receive a special email notice describing the problem. You will also be kept informed of the status any shortages.

Return Policy
Summary

Unopened items may be returned within 30 days of purchase for a full refund. Opened items are considered used and must be assessed a restocking fee. Items that are freight damaged or defective will be handled quickly and accordingly.

Details

The GPS Place allows returns on any unopened product within 30 days of purchase. If the product has not been opened, you may return it for a full refund (less shipping charges).

Products that have been opened must be considered used. Opened products may be returned after obtaining a Return Merchandise Authorization (RMA) from The GPS Place. Certain exclusions and conditions apply.

The following items cannot be accepted for return:

• Items in the category "e;GPS Software"e; or "e;GPS Instructional DVDs"e; (opened)
• Items sold on Ebay or in Auctions (opened or unopened)
• Items with rebates (opened or unopened)

Restocking Fee
The standard restocking fee for opened items is 20% of purchase price of the actual item (not including shipping).

Procedure
If you wish to return your product, please send an email to:

We will contact with you with an RMA along with return instructions.

Condition upon return
The product being returned should :

• be undamaged and free of dents, dings, scratches, etc.
• be in full working order
• have all its original materials (e.g. manuals, cables)

Products that have been damaged or are missing components may not be accepted for return or we may elect to apply an additional handling restocking fee. Restocking fees will not exceed 30%

Shipping Charges
The GPS Place does not refund original shipping charges. You are also responsible for the shipping charges incurred while returning the product.

Refund
Upon receipt of your return and upon inspecting it to ensure it meets the requirements, a refund will be provided via the original payment method (i.e. Visa, MasterCard, American Express, Discover, or PayPal). The refund will be issued in about 7 business days following our receipt of the return. You will be sent a refund acknowledgement via Email.

Defective items
The GPS Place sells items from some of the finest manufacturers in the electronics industry today and each item will have a manufacturer warranty included. Most items are warranted for one year. In the unlikely event there is a defect in a product you purchase from us, please contact us immediately. We will work with you to get a warranty exchange for your product.

Items damaged in shipping
Although unlikely, if you receive an item that has been damaged in shipping please contact us immediately. We will work with the freight company to file any necessary claims and will work with you to get a replacement product.

Limitation of Liability Policy

Summary

Customers are expected to use their products in a safe manner.  For example, if you install a GPS in your vehicle, the driver of the vehicle should not use the GPS while driving in a way that distracts.  The GPS place will not be help liable for misuse of any of the products.

1. Definitions.
"e;Absolute Quality Enterprises"e; businesses are interactive on-line service businesses that provide a variety of services and products. This web-based business (The GPS Place) is a subsidiary of Absolute Quality Enterprises that operates on the World Wide Web. “Consumer” is any person, business, corporation or other entity that purchases or otherwise uses a service or product sold by The GPS Place.

2. General.

(A) This Agreement sets forth the terms and conditions that apply to all customers of any of The GPS Place.  By using this web site, or by buying any product or service (other than to read this Agreement for the first time), Subscriber agrees to comply with all of the terms and conditions hereof.

(B)  The GPS Place shall have the right at any time to change or discontinue any aspect or feature of The GPS Place web site including, but not limited to, content, hours of availability, and equipment needed for access or use. The entirety of this document is subject to change, modification and revision at any time, without notice to the consumer.

3. Disclaimer of Warranty; Limitation of Liability.

(A) THE CONSUMER EXPRESSLY AGREES THAT USE OF ANY SERVICE OR PRODUCT MADE AVAILABLE VIA THE GPS PLACE IS AT THE CONSUMER’S SOLE RISK: THAT EACH SERVICE OR PRODUCT MUST BE USED WITHIN THE NORMAL SCOPE OF IT’S USAGE AS DEFINED SOLELY BY THE GPS PLACE. NEITHER THE GPS PLACE, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT/PRODUCT PROVIDERS OR LICENSORS WARRANT THAT THE GPS PLACE PRODUCTS OR SERVICES WILL BE RESPONSIBLE FOR ANY USE OF A OFFERED SERVICE OR PRODUCT THAT GOES BEYOND THE SCOPE OF THE INTENDED USE OF THAT PRODUCT OR SERVICE AS DEFINED SOLELY BY THE GPS PLACE.  ANY USE OF ANY PRODUCT OR SERVICE THAT EXCEEDS THE RECOMMENDED USE OF THE PRODUCT OR SERVICE VOIDS ANY WARRANTY AND ANY DAMAGE TO PROPERTY OR PERSON ATTRIBUTED TO MISUSE OR IMPROPER USE AS DEFINED SOLELY BY THE GPS PLACE RESULTING IN ANY MONETARY OR PHYSICAL DAMAGE TO PROPERTY OR PERSON IS THE SOLE RESPONSIBLILITY OF THE USER AND THE GPS PLACE  IS HELD HARMLESS BY THE CONSUMER REGARDING ANY SUCH DAMAGES.

(B) PRODUCTS AND SERVICES THAT MAY BE PROVIDED BY THE GPS PLACE ARE PROVIDED ON AN "e;AS IS"e; BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

(C) THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY USE OF ANY PRODUCT OR SERVICE PROVIDED BY THE GPS PLACE, EITHER DIRECTLY OR INDIRECTLY, THROUGH PARTNERS OR ASSOCIATES OF THE GPS PLACE, OR IN ANY WAY, DUE TO ANY FAILURE OF PERFORMANCE, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION.  THE RISK OF INJURY FROM THE MISUSE OF THE GPS PLACE OR PRODUCT IS SOLELY THE RESPONSIBILITY OF THE CONSUMER.

8. Indemnification.
Consumer agrees to defend, indemnify and hold harmless The GPS Place, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of any The GPS Place  product or service.

This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof. This Agreement shall be construed in accordance with the laws of the State of Washington, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.
